A specific issue has been addressed to me, and I offer this specific answer.
Concerning, Trial lawyers, and law firms, who take massive rewards from settlements, rewards which many argue should be paid to those plaintiffs, and not to lawyers, lawyers whom many refer to as vampires.
Rather than immediately write and put forward an executive order, I would pressure Congress to pass Legal Reform, which many refer to as Tort reform.
I favor Tort reform, but only in specific ways.
1) I will call for Trial lawyer reform, specifically, to say that we set a scale... (This is just an example!!!)
settlements from 1-100,000 Dollars, lawyers may ask (charge) only up to 30%,
from 100,000 to 1,000,000 up to 20%,
1,000,000-100,000,000 up to 15%,
and 100,000,000 -1,000,000,000 up to 10%,
and anything above one Billion dollars, up to 5%.
(This scale is just an example, as this scale is 'very' generous to lawyers. And it would be best if Congress was to decide upon such a scale and its exact numbers.)
2) The other half of the problem is, the SYSTEM, HAS ALLOWED FOR THE BIG PAYOFFS, as the means to motivate lawyers to take on cases, of in-justice, which they might ordinarily not accept as clients!!!!!
WHAT DOES THE POOR WORKER DO when no lawyers will take their case????????
.. because its not worth enough money...
.. because of the odds of winning...
...because of the lack of big money rewards...
THAT IS THE PROBLEM.... no one will take the case....
I, therefore, will add as part of my Legal reform package... the establishment of community law centers, where court appointed attorneys will work on behalf of all those who cannot gain the interest of FOR-PROFIT law firms. So they can honestly have their cases examined, considered, and brought before a judge to consider the details as known... and these government lawyers, are paid by salary, and all rewards would by law, go to the victims, and plaintiffs, instead of the lawyers. (minus a small fee, for court costs)
3) I would also call for and demand immediately that all court appointed defense attorneys base pay per case be increased, and their case loads reduced by law, and that all excess forms of collusion on plea bargaining for rapid case processing be punishable by jail time for lawyers and prosecutors alike, in cases which may be disputed by defendants, who felt pressured or coerced to plea guilty or 'no contest' to crimes to which they claim innocence. This will effectively force defense attorneys to do their job, and take their time.
