State powers : The Constitution was set up to allow both the people and states to have clear representation in the Congress, via representatives of the people in the House, and Senators which represent the states in the Senate, but the 17th amendment, which many say was not ratified properly, robbed the states of representation, by robbing the states of the appointment of Senators, and gave that power to voters, who can be mislead so as to opposes the state as a power structure, which directly robs the states of their ability to put forth controlled lobbying in congress by appointing Senators to vote based on the wishes and intent of the legislature of any given state. (The Senate is supposed to represent the State legislatures, to prevent the Federal Government from taking to much power!)
Proposed solution for State powers :
a) Basically, the 17th amendment must be reviewed, and Senators, should ask their states how they should vote on ratifying said amendment, or not, because State sovereignty is Key in maintaining the republic and the limited government our Constitution is meant to provide.
b) Also, many of the NEW DEAL regulatory powers of the Federal government should be transferred to the states, to regulate as they see fit, so as to vary these controls based on the will of the people of various states. As such, those state controls may be mandated by amendment of the U.S. Constitution so that the states are responsible for those regulatory functions which thereby frees the Federal government of the choir, and places the burden of financing on the states and their treasuries.
c) Certain powers of regulation should however be kept at the Federal level so as to maintain consistency across all states, such as the CDC, FAA, FDA, and other safety based functions of national importance, where by variations should be prevented. Yet, things like the FCC, and other business regulatory powers, as such, should be held by the States, to adjust their business environment as they see fit, to limit or promote various practices in commerce.
